ASSAULT

Client was charged with assault upon a peace officer, violating Penal Code 245(C); assault with a deadly weapon with vehicle, violating Penal Code 245(A)(1); and resisting, obstructing, or delaying a peace officer, violating Penal Code 240.

Peace officer had parked in front of client's driveway. The client was given a citation under the Woodlake Municipal Code by a peace officer for watering their front lawn, due to the California drought. Client had proceeded to enter their car located in the property's garage and reversed onto to driveway, then returned. Peace officer attempted to arrest client, but the client fled back into the house, later surrendering, and arrested.

Count 1 of assault upon a peace officer (Penal Code 245(C)) and Count 2 of assault with a deadly weapon with vehicle (Penal Code 245(A)(1)) were both dismissed. Misdemeanor of Count 3 with resisting, obstructing, or delaying a peace officer (Penal Code 240) was found guilty however under Tulare County Superior Court.
