Client was charged with a misdemeanor for driving under the influence (DUI), a violation of Penal Code 23152(a) and also for driving .08% or more for alcohol in their blood (BAC), a violation of Penal Code 23152(b). However, the prosecution failed to prove that the client was driving because he was parked, and the car wasn't moving. 

Client was found not guilty in Tulare Supreme Court.
