Cyberstalking: Know the Boundaries

Posted by Christopher Martens | Feb 10, 2015 | 0 Comments

Humans are all different and so conflict between people is normal and natural for society. We can all say or do things in the heat of the moment, even when we don't really intend on hurting the person. Unfortunately, stalking, cyberstalking and related crimes are very serious and have grave consequences. California state penal code 646.9 dictates that cyberstalking involves willful, malicious and repeated harassment against another person; cyber meaning it is done through digital means. PC 646.9 states that the harassment must be done with the intent of making someone fear for his or her safety and it must be a reasonable enough cause for fear in the first place. Dramatically unreasonable threats or threats that were blatantly intended to be comical aren't considered criminal but this defense is up to the discretion of the court and how well you plead your case. Online, words can be misconstrued and interpreted outside of context. If you feel someone who is now pressing charges against you misinterpreted your actions or behaviors, be sure to consult with an attorney before you take any formal actions. It is always a good investment to hire an experienced criminal defense attorney to help you best represent your self in court. Stalking is a serious offense and a conviction can have long lasting affects on your life. You can face steep fines, jail time and discrimination in the workforce. In addition, the social ramifications of having a cyberstalking conviction can be worse than what the courts hand down to you. If you feel you have unfairly been accused of cyberstalking, there is hope. Don't accept an unfair judgment; know how to best represent yourself in court to ensure the best possible outcome for your case.
