Inaccurate Blood Alcohol Content (BAC) Readings

Posted by Christopher Martens | Jan 12, 2015 | 0 Comments

Drinking and driving is a common, yet serious, offense. In California, driving with a BAC (blood alcohol content) higher than .08% is illegal, according to California Vehicle Code 23152-23229.1. However, blood alcohol content is not always a direct reflection of how impaired you were while driving. You have a right to have a blood test demonstrate your BAC rather than an in-field breathalyzer test. If you choose to do so, be aware your BAC can actually arise between the time you are arrested and when the blood is analyzed. BAC takes time to manifest and so if you drank shortly before driving, you may be at a disadvantage when it comes to blood tests, which are taken some time after being pulled over. If you feel like you could have been unfairly charged with a DUI under these circumstances, contact an experienced DUI defense attorney right away. Being charged with a DUI is a hard experience. Time, money, and at times your dignity will be spent on recovering from your mistake. Strict BAC regulations and dedicated DUI forces make driving under the influence in California more of a risk than ever.
