According to Perfect Union, the National Labor Relations Board has ruled that if bosses commit unfair labor practices in the run-up to a union election, the election will be cancelled and the Board will order the employer to immediately recognize and bargain with the union.
Now, every union campaign has to go to an election to get formal recognition. However, this has become a common opportunity for bosses to union-bust, and more so illegally.
From now on since last Friday, if a majority of workers support the union, bosses are prohibited from union-busting or else would be enforced to negotiate with no option of an election involved.
As the chair of the NLRB says, “It eliminates incentives for employers to commit unfair labor practices as a way to delay/defeat representation when a majority of workers have shown support for a union.” - @NLRBMcFerran on X
